Important notice

Cosmicly is provided for personal reflection and entertainment only. It is not medical, mental-health, financial, legal, therapeutic, or other professional advice. It is not an emergency service. If you need urgent help, contact qualified professionals or local emergency services.

Readings, prompts, reports, and other personalized text may be generated with AI. AI output can be inaccurate, incomplete, or inconsistent. Treat Cosmicly as a reflective lens, not as a factual claim, professional instruction, diagnosis, or promise of a specific outcome.

1. The agreement

These Terms of Service (the "Terms") form a contract between Gunveer Sandhu, an individual sole proprietor doing business as Cosmicly ("Cosmicly", "we", "us", or "our"), and you.

These Terms govern your use of the Cosmicly mobile app, website, and related services. By installing the app, creating an account, starting a trial, purchasing a subscription, or using Cosmicly, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Cosmicly.

On iOS, Apple's Standard End User License Agreement also applies. On Android, Google Play's applicable terms also apply.

2. What Cosmicly is

Cosmicly is a Vedic astrology and reflection app. It uses information you provide, such as birth details, profile settings, optional location, palm photos if you use palm reading, and reflections or journal responses, to generate personalized readings, prompts, reports, and timing guidance.

Cosmicly is designed to support reflection, self-awareness, and everyday decision-making. It does not replace your own judgment or the advice of qualified professionals.

We may add, change, limit, or remove features as the product develops. If a material change affects a paid feature, we will provide reasonable notice through the app, website, email, or another appropriate method.

3. AI-generated and interpretive content

Some Cosmicly features use AI-generated language. You understand and agree that:

  • AI-generated content may be wrong, incomplete, delayed, repetitive, or inconsistent.
  • Astrology, palm reading, and reflective prompts are interpretive practices, not scientific guarantees.
  • Cosmicly does not promise that any reading, report, or prompt will be accurate or produce a particular result.
  • You are responsible for decisions you make after reading Cosmicly content.

You may not use Cosmicly to extract system prompts, bypass safeguards, scrape content, attack the service, or train, fine-tune, evaluate, or build another AI or machine-learning system without our prior written permission.

4. Eligibility

You must be at least 13 years old to use Cosmicly. If your country or region requires a higher age for digital consent, that higher age applies. You must have the legal capacity to enter into these Terms.

5. Your account

You are responsible for your account and for keeping your login credentials secure. You agree to provide accurate information, especially birth details and other profile information that affects your readings.

You may not share your account, impersonate another person, use someone else's account, or create accounts in a way that abuses trials, subscriptions, referrals, or app functionality.

6. Privacy

Our Privacy Policy explains what we collect, how we use it, and your choices. By using Cosmicly, you acknowledge that your use is also governed by the Privacy Policy.

7. Subscriptions, trials, and payments

Cosmicly may offer free features, paid features, subscriptions, free trials, promotional offers, or referral rewards. The details shown at the point of purchase or redemption apply to that offer.

If you buy through the Apple App Store or Google Play:

  • Payment is charged by the applicable app store.
  • Subscriptions renew automatically unless canceled before the renewal deadline shown by the store.
  • You can manage or cancel subscriptions through your Apple ID or Google Play account settings.
  • After cancellation, paid access usually continues until the end of the current billing period.
  • Refund requests are handled by Apple or Google unless applicable law requires otherwise.

We do not receive your full payment card details.

8. Acceptable use

You agree not to:

  • Use Cosmicly in violation of law.
  • Use Cosmicly for emergency, medical, mental-health, legal, financial, or other professional decisions.
  • Harass, threaten, abuse, impersonate, or harm another person.
  • Upload content you do not have the right to provide.
  • Upload unlawful, hateful, sexually explicit, exploitative, or harmful content.
  • Probe, scan, attack, disrupt, reverse-engineer, or attempt unauthorized access to the app or backend.
  • Scrape, resell, sublicense, or commercialize Cosmicly or its outputs.
  • Use Cosmicly outputs or data to train, fine-tune, evaluate, or build AI or machine-learning systems without written permission.
  • Abuse subscriptions, trials, referral rewards, promotions, support, or account systems.

We may suspend or terminate accounts that violate these Terms or create legal, safety, security, or operational risk.

9. Your content

"Your content" means information or material you submit to Cosmicly, including profile fields, reflections, journal entries, palm photos, feedback, and support messages.

You retain ownership of your content. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your content only as needed to provide Cosmicly, personalize your experience, operate the service, improve reliability and safety, and comply with law.

This license does not allow us to sell your content, use it for third-party advertising, or use it to train AI models. The license ends when your content is deleted, except for backups, legal obligations, security records, or de-identified information that can no longer reasonably identify you.

10. Generated content

Personalized readings, reports, prompts, summaries, and other content generated for your account are provided for your personal, non-commercial use. You may read, save, screenshot, or share them for personal purposes, but you may not resell them, present them as professional advice, or use them to build a competing product or AI system.

We retain ownership of Cosmicly's app, code, design, trademarks, content templates, prompts, models, systems, and non-personal aggregated insights.

11. Intellectual property

Cosmicly's name, logo, design, software, written content, visual assets, prompts, templates, and other product materials are owned by us or our licensors. These Terms do not transfer ownership of those materials to you.

Traditional astrology terms and concepts remain part of their respective public, cultural, or traditional knowledge contexts and are not claimed as our exclusive property.

12. Safety and professional advice

Cosmicly is not a crisis service, medical device, therapeutic service, financial advisor, legal advisor, or substitute for professional care. Do not use Cosmicly to diagnose, treat, prevent, or manage any health, mental-health, legal, financial, or safety issue.

If you are in danger, experiencing a crisis, or considering self-harm, contact local emergency services or a qualified crisis resource immediately.

13. Disclaimers

To the fullest extent permitted by law, Cosmicly is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, secure, error-free, accurate, complete, or suitable for your particular purpose.

We do not guarantee any outcome from using Cosmicly.

14. Limitation of liability

To the fullest extent permitted by law, Cosmicly and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption, arising from or related to your use of Cosmicly.

To the fullest extent permitted by law, our total liability for any claim related to Cosmicly or these Terms will not exceed the amount you paid for Cosmicly in the 12 months before the claim, or INR 5,000 if you paid nothing.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cosmicly from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Cosmicly, your content, your violation of these Terms, or your violation of another person's rights.

16. Termination

You may stop using Cosmicly at any time. You may delete your account in the app.

We may suspend or terminate access if you violate these Terms, misuse the app, create security or legal risk, or if we are required to do so by law. Sections that by their nature should survive termination will continue to apply.

17. Third-party services

Cosmicly relies on third-party services for hosting, authentication, AI generation, analytics, crash reporting, notifications, subscriptions, sign-in, app distribution, and payment processing. Their own terms and policies may apply when you use those parts of Cosmicly.

We are not responsible for third-party service outages, policies, actions, or content.

18. Changes to these Terms

We may update these Terms as Cosmicly changes. If the change is material, we will provide notice in the app, on the website, by email, or by another reasonable method. The "Last updated" date shows when these Terms were last changed.

Continued use after changes become effective means you accept the updated Terms.

19. Governing law and disputes

These Terms are governed by the laws of India, excluding conflict-of-laws rules.

Any dispute arising from these Terms or Cosmicly will be resolved in the competent courts of Bikaner, Rajasthan, India, except where mandatory consumer protection law gives you rights that cannot be waived.

If any provision of these Terms is unenforceable, the remaining provisions remain in effect.
